These Terms & Conditions govern use of the Five Stones Landscape website and online store and purchases made through the site. By accessing the website, placing an order, or using website services, customers agree to these Terms & Conditions and to the policies incorporated by reference below.

Website & Store Use

Customers may use the Five Stones Landscape website and online store for lawful personal or business purchasing purposes. Users may not misuse the website, interfere with its operation or security, attempt unauthorized access, introduce malicious code, scrape or reproduce website content in an unauthorized manner, or use the website for fraudulent or unlawful activity.

Product Information

Five Stones Landscape makes reasonable efforts to provide accurate product names, descriptions, photographs, specifications, pricing, and availability. Plants and natural materials vary in color, shape, size, branching, bloom, texture, and appearance, and photographs are representative rather than guarantees of an identical specimen.

Plant dimensions, growth rates, hardiness, water needs, bloom periods, and other horticultural information are general guidance. Actual performance depends on site conditions, weather, soil, irrigation, maintenance, planting practices, and other factors.

Inventory & Availability

Inventory shown online is subject to change and is not guaranteed until an order is confirmed. Five Stones Landscape may correct inventory errors, limit quantities, substitute or remove unavailable items with customer approval where appropriate, or cancel and refund or credit an unavailable item according to the applicable order circumstances.

If an item becomes unavailable before an online order is processed or fulfilled, Five Stones Landscape may contact the customer and allow the customer to choose an available substitute, refund, or store credit, as appropriate.

Pricing, Taxes & Errors

Prices are displayed in U.S. dollars and may change without notice. Applicable sales tax, delivery charges, installation charges, handling charges, or other disclosed service charges may be added before an order is completed.

Five Stones Landscape reserves the right to correct typographical, pricing, product-information, or system errors. If a material pricing error is discovered after an order is placed, Five Stones Landscape may contact the customer before fulfillment to confirm the corrected price or cancel the affected item and return the applicable payment.

Orders & Acceptance

Submitting an online order does not guarantee acceptance. An order is accepted when Five Stones Landscape confirms and processes the order for fulfillment. Five Stones Landscape may refuse or cancel an order when reasonably necessary because of inventory errors, pricing errors, suspected fraud, payment problems, delivery limitations, safety concerns, prohibited use, or other legitimate business reasons.

Payment

Customers must provide accurate billing and payment information. Online payments are processed through third-party payment service providers. Five Stones Landscape may delay or cancel fulfillment when payment cannot be authorized or when additional verification is reasonably required.

Order Changes & Cancellations

Requests to change or cancel an order must be made within 24 hours of ordering or before fulfillment, whichever occurs first. Five Stones Landscape cannot guarantee that an order can be changed or canceled after merchandise has been pulled, prepared, loaded, delivered, installed, specially ordered, or otherwise processed.

Any approved cancellation, return, restocking charge, refund, or store credit is subject to the Five Stones Landscape Returns & Refunds Policy and any applicable product-specific restrictions.

Customer Pickup & Delivery

Customer pickup and local delivery are governed by the Five Stones Landscape Shipping & Delivery Policy. Customers are responsible for providing accurate contact and delivery information, suitable pickup transportation, and safe and reasonable delivery access.

Delivery dates and times are estimates and may be affected by weather, traffic, product availability, equipment, site conditions, or other circumstances. Delivery, installation, labor, and other service charges are handled according to the applicable Five Stones Landscape policies.

Returns, Refunds & Store Credit

Returns, refunds, exchanges, restocking charges, product exclusions, and store credits are governed by the Five Stones Landscape Returns & Refunds Policy. Customers should review that policy before completing a purchase. Where these Terms & Conditions and the Returns & Refunds Policy address the same return matter, the more specific Returns & Refunds Policy controls.

Plant Guarantee & Claims

Plant-health claims and warranty coverage are governed by the Five Stones Landscape Plant Guarantee & Claims Policy. Eligibility, customer responsibilities, claim documentation, exclusions, store-credit remedies, and applicable time limits are determined under that policy.

Installation & Landscape Services

Standard product delivery does not include planting or installation unless installation services are specifically included in the customer’s order or separate service agreement. Plant placement, planting, landscape construction, removal, or other labor may be subject to separate estimates, contracts, warranties, and terms.

Customer Accounts & Loyalty

Customers are responsible for maintaining accurate account information and protecting account credentials. By entering an email address through checkout, that email address will serve as the customer’s account.

Every retail account receives store credit equal to 5% of the total ticket value. Store credit may be saved and accumulated, has no expiration, may be redeemed in-store or online, and has no cash value. Five Stones Landscape retains the right to remove or delete accounts at any time.

Five Stones Landscape may modify or discontinue loyalty, rewards, discount, or promotional programs subject to any terms specifically provided with those programs.

Promotions, Discounts & Gift Cards

Promotions, coupons, discounts, and special offers may be subject to additional terms, expiration dates, product exclusions, quantity limits, or availability restrictions. Unless expressly stated otherwise, promotional offers may not be combined.

Gift cards are sold online, have no expiration, and have no cash redemption value. Replacement of a gift card is available in-store. Lost or stolen cards will be replaced at their current remaining value at the time of replacement, not their previous or initial balance.

Intellectual Property

Website text, graphics, logos, branding, photographs owned by Five Stones Landscape, page design, and other original website content are owned by or licensed to Five Stones Landscape and are protected by applicable intellectual-property laws. Customers may view and use the website for ordinary shopping and informational purposes but may not reproduce, republish, sell, distribute, or commercially exploit protected content without permission.

Third-Party Services & Links

The website may use or link to third-party services, including payment, mapping, analytics, advertising, pictures, communications, or other technology providers. Five Stones Landscape is not responsible for the content, availability, security, or independent practices of third-party websites or services.

Disclaimer of Website Availability

Five Stones Landscape works to keep the website accurate and available but does not guarantee uninterrupted or error-free access. Website functions may occasionally be unavailable because of maintenance, updates, service-provider outages, technical problems, or circumstances outside our reasonable control.

Limitation of Liability

To the fullest extent permitted by applicable law, Five Stones Landscape will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of, or inability to use, the website. Nothing in these Terms & Conditions is intended to exclude or limit liability that cannot legally be excluded or limited.

Product-specific remedies and service obligations remain governed by the applicable Five Stones Landscape guarantee, return, delivery, or service agreement.

Indemnification

To the extent permitted by applicable law, users agree to be responsible for losses, claims, or expenses arising from their unlawful misuse of the website, violation of these Terms & Conditions, or infringement of another person’s rights.

Privacy

Use of personal information collected through the website is governed by the Five Stones Landscape Privacy Policy. Customers should review that policy for information about data collection, use, sharing, security, retention, and privacy choices.

Governing Law

These Terms & Conditions are governed by applicable federal law and the laws of the State of Oklahoma, without regard to conflict-of-law principles. Any dispute will be handled in an appropriate court with jurisdiction unless the parties agree to another lawful resolution method.

Changes to These Terms

Five Stones Landscape may revise these Terms & Conditions from time to time. Updated Terms will be posted on the website with a revised effective date. Changes apply prospectively unless otherwise required by law.
